Annie Ostrager, Co-Head of S&C’s Labor and Employment Group, and Litigation associate Emily Grasso authored an article in Lexis Practical Guidance, “Internal Investigations: Witness Interview Strategy and Planning,” which provides an overview of the steps of an internal investigation and specific guidance about the strategy and planning of witness interviews in internal investigations.
An internal investigation may be prompted by a number of different events, including a whistleblower complaint, an internal complaint made to human resources or business personnel, or press reports. In addition to informing internal decision-making, a company can benefit from such an investigation if a criminal or regulatory authority later investigates the same issues. “Witness interviews are typically the baseline requirement of a meaningful and thorough internal investigation,” Annie and Emily note. “Strategic planning in advance of witness interview is therefore essential to obtaining as much reliable information as possible, and in the most efficient manner.”
