Rachel Yu and KJ Lim led a Practising Law Institute One-Hour Briefing on “AI-Generated Images: Intellectual Property Considerations for ‘Text-to-Image’ Artificial Intelligence.” During the program, Rachel and KJ gave an overview of “text-to-image” generative AI technology and certain intellectual property questions it raises within the existing legal framework and discussed how intellectual property issues arise from collecting and processing image datasets and providing AI-generated images to users, including copyright infringement and violations of the Digital Millennium Copyright Act, Computer Fraud and Abuse Act, and terms of use compliance. They also provided practical guidance for AI developers, including implementing best practices regarding collection and internal use of copyrighted works, drafting clear terms of use and publishing copyright ethics standard.
