On June 17, 2019, the New York State Legislature passed the Stop Hacks and Improve Electronic Data Security Act (“SHIELD Act”), which was signed by Governor Cuomo’s office on July 25, 2019. The SHIELD Act amends and supplements New York’s existing statute covering notification of unauthorized acquisition of private information. Additionally, the SHIELD Act adds new provisions with respect to data security protections, requiring persons or businesses to “develop, implement and maintain reasonable safeguards to protect the security, confidentiality and integrity of the private information” of New York residents.
