Benjamin Beller is a special counsel in the Firm’s General Practice Group. His practice focuses on bankruptcy and restructuring. He has served clerkships with the Honorable Robert E. Gerber and the Honorable Shelley C. Chapman of the US Bankruptcy Court, Southern District of New York. Ben was an associate at a prominent international law firm for six years prior to joining S&C in June 2020.

 

SELECTED REPRESENTATIONS

  • Deerfield Management as senior secured creditor, DIP lender and plan sponsor in the Chapter 11 cases of Endologix; and as the largest second lien holder in the restructuring of Mallinckrodt
  • Lion Capital in its affiliate’s DIP financing for and acquisition of John Varvatos Enterprises in a Section 363 sale process
  • Bluestone Resources and members of the Justice family in a 2021 action against Greensill Capital alleging fraud and breach of contract regarding $850 million of financing
  • Garrett Motion in its Chapter 11 bankruptcy proceedings
  • Minera Los Pelambres in its dispute with Alto Maipo arising under a Power Purchase Agreement and in connection Alto Maipo’s Chapter 11 proceeding
