Clients turn to S&C for some of their most difficult products liability challenges across a range of industries, including matters involving automobiles, airplanes, pharmaceuticals, beverages, welding rods, roofing shingles and pacemakers. S&C has been at the forefront of finding innovative and effective strategies to resolve these matters, most recently, in the automotive realm with our representation of Volkswagen, Audi and Fiat Chrysler in diesel emissions matters.
We partner with our clients to master the facts and tailor strategies for products liability issues that meet each client's business objectives. The Firm is particularly adept at assessing risk and managing complex lawsuits involving multiple jurisdictions, multiple plaintiff-groups (including consumers, regulators and investors) and teams of local counsel.
Our recent achievements in products liability matters include:
- successfully defending Volkswagen in a bellwether trial against claims by vehicle owners who opted out of the company’s settlement to resolve diesel emissions issues;
- curbing airbag product liability claims for Volkswagen and Audi;
- steering Volkswagen through a three-year compliance audit;
- substantially paring back a putative nationwide consumer class action involving Ram trucks made by Fiat Chrysler Automobiles (FCA); and
- winning an appellate ruling for FCA affirming that product defect claims can be effectively curtailed through a bankruptcy sale contract.
