On February 28, 2024, President Biden issued Executive Order 14117, “Preventing Access to Americans’ Bulk Sensitive Personal Data and United States Government-Related Data by Countries of Concern,” delegating new authorities to the U.S. Department of Justice and other agencies to regulate the transfer of sensitive U.S. data to countries of national security concern. Simultaneously, the Department of Justice issued an Advance Notice of Proposed Rulemaking that spells out the contemplated regulatory regime, which will prohibit or restrict certain transactions by U.S. persons and companies that involve sensitive data. The Executive Order grants the Department regulatory and criminal enforcement authority to ensure compliance with these regulations.
