On December 4, the CFTC issued for public comment proposed guidance regarding the listing for trading, by designated contract markets, of voluntary carbon credit derivative contracts. The Proposed Guidance outlines factors that DCMs should consider when addressing certain requirements under the Commodity Exchange Act and CFTC regulations applicable to the listing of new derivative contracts. The Proposed Guidance reflects the CFTC’s interest in promoting the development of carbon credit derivative markets and in clarifying its role in connection with the underlying physical market. Comments on the Proposed Guidance are due by February 16, 2024.
