S&C litigation partners Alexander Willscher and Judd Littleton and litigation associate John Liolos authored an article for Law360 analyzing last week’s oral arguments in AMG Capital Management LLC v. FTC, a case that could determine the scope of the FTC’s ability to obtain monetary remedies in its enforcement efforts. The authors note that several justices expressed “significant skepticism of the FTC’s position,” suggesting that the agency’s ability to seek monetary relief may be under “serious threat.”
