In its February/March 2018 issue, Practical Law published an article co-authored by Diane McGimsey and Judson Littleton titled “Expert Q&A on Seeking or Opposing Certiorari in the US Supreme Court.” The article explored how the Supreme Court decides whether to grant certiorari to in a particular case, and what a party and its counsel can do to show that their case is certworthy. Diane and Judson also discussed when a petitioner should consider soliciting the participation of an amicus curiae, when a respondent should file a brief opposing certiorari and how a respondent can best avoid Supreme Court review when opposing certiorari.
