On October 19, 2022, in Community Financial Services Association of America, Ltd. v. Consumer Financial Protection Bureau, the United States Court of Appeals for the Fifth Circuit ruled that the Consumer Financial Protection Bureau’s funding mechanism violated the separation-of-powers principles found in the Constitution’s Appropriations Clause. This conclusion led the court to vacate the CFPB’s Payday Lending Rule.
