S&C Wins Motion to Dismiss for Volaris

Judge William H. Pauley III of the U.S. District Court for the Southern District of New York dismissed with prejudice all claims in a putative class action filed against Volaris, a Mexican airline, certain of its current and former directors and officers and certain underwriters of its IPO under Sections 11 and 15 of the Securities Act of 1933. In February 2017, the Court of Appeals denied Plaintiff-Appellants' motion for re-argument or, in the alternative, for leave to appeal.
S&C represented Volaris and the individual defendants. The S&C team was led by New York partner Bob Giuffra, who argued the motion, and included partners David Rein and Sergio Galvis and special counsel Matthew Peller.
