To help employers navigate workplace issues during the Coronavirus outbreak, S&C lawyers have coauthored an article for Reuters: “Employers’ Guide to the Fair Labor Standards Act and the Family and Medical Leave Act During the Coronavirus Outbreak.” The article is a collaboration among Litigation Group partners Theodore O. Rogers, Jr., Julia M. Jordan, Tracy Richelle High and Ann-Elizabeth Ostrager, and associates Katharine Rodgers and Kathleen Donnelly.
The authors provide insights into new Department of Labor guidance on common issues employers may face in responding to various Coronavirus scenarios or other public health emergencies under both the Fair Labor Standards Act and the Family and Medical Leave Act. Issues addressed include rules governing compensation for exempt and non-exempt employees during business closures; increased expectations for employees who are able to work; when employees may be entitled to FMLA; and requirements for paid leave and sending employees home.
