Matthew Schwartz and Corey Omer Co-author Banking Perspectives Article on Constitutionality of State Cybersecurity Regulations

In its second quarter issue, The Clearing House’s Banking Perspectives published an article co-authored by Matthew Schwartz and Corey Omer titled “The Constitutionality of State Cybersecurity Regulations.” The article explores whether aspects of newly emerging state cybersecurity regulations for financial institutions violate the Dormant Commerce Clause of the U.S. Constitution.  The article also considers whether cybersecurity regulations should be handled on a federal basis.  “Cybersecurity, like the Internet, is geographically unbounded and, as such, requires serious consideration of a national solution,” Matthew and Corey concluded.
