S&C litigation partners Joseph Neuhaus and Andrew Finn, together with litigation associate Aviva Galpert, have authored an article for Bloomberg Law on the rise of court-ordered discovery in the U.S. for use in international arbitrations abroad, and the risks posed to multinational companies with a presence in the U.S. The authors detail conflicting court rulings on whether a federal statute authorizing discovery—28 U.S.C. § 1782—applies to international arbitrations, and offer tips for companies who use arbitration for dispute resolution to mitigate this emerging discovery risk.
