Nic Bourtin Authors Expert Q&A on DOJ’s Yates Memo in Practical Law The Journal

In its April/May issue, Practical Law The Journal published an article by Mr. Bourtin titled “Expert Q&A on the DOJ’s Yates Memo.” The article explores the significance of the DOJ’s September 2015 Yates Memo, a document that “instructs all DOJ attorneys to focus on individual accountability when investigating and resolving matters of corporate misconduct” as a deterrent to illegal corporate activity. Mr. Bourtin explained the implications of the Yates Memo’s provisions—including a new “all-or-nothing” approach to granting cooperation credit to companies—and gave advice to counsel representing both companies and individuals under DOJ investigations.
