July 2009

Mr. Aquila and Mr. Galvis published an article titled, "The Prey Become Predators: Latin American Companies Become Players on Global M&A Stage," which appeared in Crítica, a digital magazine in Chile; El Cronista, a leading business and financial newspaper based in Argentina; Mercado, a monthly business magazine in Argentina; La Nación, a nationally circulated newspaper in Chile; Portafolio, a leading financial publication in Colombia; and Reforma, a daily newspaper in Mexico. The article discusses the increasing prevalence of Latin American countries on the global economic stage. The authors explore the complexities involved in cross-border deals and share key advice on what Latin American acquirers should consider when the target company is outside their home country. The authors also note that acquirers should be aware of local and cross-border disclosures, regulations, monetary authority filings/approvals, reporting requirements, insider trading rules, the risk of litigation and cultural differences.
