Fusions transfrontalières, quel avenir ?November 30, 2007
In its November 30, 2007 issue, Pg. 12 N°. 2005, Les Echos published an article by Gauthier Blanluet regarding the implementation of the EU cross-border merger directive (2005/56/CE). He specifically points out that in transposing the directive, French legislators may be overlooking a fundamental point related to employee approvals necessary to complete a merger. The original directive provides for simpler processes to bypass long employee negotiations that delay merger transactions and that, if not taken into account under French law, may impede the progress of cross-border mergers involving French companies in the future.
