Nicole Friedlander was interviewed by “Critical Mass,”’s briefing on class actions and mass torts, on the U.S. Supreme Court’s rejection of certiorari in a data breach class action. The Supreme Court rejected a cert petition in CareFirst v. Chantal Attias, which many hoped would clarify when data breach plaintiffs have standing to sue in federal court. “The decision means plaintiffs are going to have an easier time in the DC Circuit, but potentially elsewhere, establishing standing, which has been one of the most significant issues in data breach class actions and the most significant hurdle that plaintiffs have had to try to clear,” Nicole said. “Certainly plaintiffs, even outside the DC Circuit, will raise this decision and ask other federal courts to consider it as they make decisions in their own circuits.”
