Wall Street Journal, Reuters and Law360 Cover Recent Win for Volkswagen

On August 31, S&C obtained the dismissal of claims brought by the state of Wyoming against client Volkswagen and its subsidiary Audi. Wyoming alleged that VW had violated its state environmental laws and sought potentially billions of dollars in damages, but Judge Charles R. Breyer of the Northern District of California dismissed these claims on the grounds that the penalties the company had already faced from consumers and federal authorities in connection with its emissions issues were sufficient. The dismissal has implications for other cases brought by similarly situated states and counties. The Wall Street Journal noted that the dismissal “put to rest a sizable risk the German auto maker faced.”
 
Reuters reported that Bob Giuffra had said that “it would make it impossible in the future for auto manufacturers to actually enter into the kinds of global settlements that Volkswagen did” if Wyoming had won the suit. “Volkswagen is pleased with Judge Breyer’s important decision to dismiss Wyoming’s claims,” Bob told Law360, which featured the dismissal in its weekly Legal Lions list. “Judge Breyer recognized that Volkswagen has fully remediated the environmental harm from the diesel matter.”
