Jeff Wall Quoted in Law360 Article on Favorable Supreme Court Patent Case Decision

On June 13, Mr. Wall was quoted in a Law360 article titled “High Court Relaxes Standard For Enhanced Patent Damages,” which broke the news of the U.S. Supreme Court's invalidation of the Federal Circuit's test for awarding enhanced damages to patent owners in patent infringement cases. When the Federal Circuit applies this test, which many criticized as too difficult for patent owners to meet, “a large number of the worst infringers, even bad faith copiers, are immunized from any enhancement,” according to Mr. Wall, who argued for S&C client Stryker Corp., the patent owner in one of the relevant cases. The Stryker case was sent back to the Federal Circuit to be reconsidered under the new, less strict test. Messrs. Beeney, Giuffra and Raynor also represented Stryker in the case.
