August 15, 2017

On August 15, The Am Law Litigation Daily published an article titled “Hot Cross Buns: These Sullivan & Cromwell Litigators Show How to Grill a Witness” about the dismissal of a case against S&C client Micro Systems Engineering Inc. (MSEI) involving copyright, trade secret and contractual claims related to software source code. David Tulchin and Thomas White led the S&C team that represented the medical device maker against claims brought by Universal Instruments Corp. After a six-day jury trial, and before either side delivered closing arguments, The Honorable Gary L. Sharpe of the U.S. District Court for the Northern District of New York granted MSEI's Rule 50 motion for judgment as a matter of law. The article outlined how David's and Thomas's deft cross-examination style enabled them to expose flaws in the plaintiffs' claims, and included trial and cross-examination tips from David.
