Rick Pepperman Named Litigator of the Week by The American Lawyer

On January 14, The American Lawyer named Mr. Pepperman Litigator of the Week for his work in obtaining the dismissal of a proposed class action lawsuit that claimed Goldman Sachs Group Inc. and JPMorgan Chase & Co. were involved in an antitrust violation that increased zinc prices. Winning this dismissal was particularly challenging because the judge reviewing Goldman's motion to dismiss, U.S. District Judge Katherine Forrest, had recently refused to dismiss a parallel aluminum antitrust action. Mr. Pepperman and his team successfully established key differences between the two cases. The Judge ruled that the plaintiffs had not adequately alleged why Glencore and Pacorini, other defendants that dominate the zinc market, might have required the involvement of Goldman and JPMorgan to carry out such a scheme. The plaintiffs' lawyers were blocked from amending and re-filing their complaint with respect to Goldman and JPMorgan.
