Adam Paris Interviewed by GC Agenda on FTC Merger Remedies Report

March 28, 2017

In its March/April 2017 issue, Adam Paris was interviewed by GC Agenda, which provides “a round-up of major horizon issues for General Counsel.” Adam contributed to the Antitrust section, which discussed a recent Federal Trade Commission report that explains how to best demonstrate that a proposed merger remedy will resolve any competition issues identified by the FTC in a proposed merger. The section notes that, while much of the FTC's current approach to merger remedies is likely to remain unchanged, some aspects of the approach are likely to become more stringent. “For example, the Remedies Report recommends that counsel identify at least three potential divestiture buyers that are interested and approvable,” the article said. “This departs from past agency practice and could be impracticable depending on the industry.”
