Law360 Profiles S&C’s Appellate Practice for its 2016 Practice Group of the Year Win

On February 8, Law360 published a profile of S&C's appellate practice as part of the group's 2016 Practice Group of the Year win. The article outlined the Firm's win in a patent damages matter in front of the U.S. Supreme Court, as well as an array of successes in representing financial institutions in New York and Delaware state and federal appeals courts, among other cases. On the patent case, Stryker Corp. v. Zimmer Inc., Jeffrey Wall noted, “This was one of those cases where it's pretty easy to criticize what the lower court is doing, and the trick is explaining to the court what the new rule ought to be and getting them comfortable that the rule is going to achieve the right trade-off between protecting property rights and promoting innovation.”

Bob Giuffra also explained how the Firm's ongoing work for financial institutions—such as JPMorgan Chase & Co., Goldman Sachs Group and UBS AG—can result in successful appellate work when lawyers are familiar with a case from the beginning. “You have a huge advantage because when you've been living with a case and then you handle the appeal, you're in a position where you know every issue, and you've considered what the appellate issues are likely to be when you've handled it in front of the trial court,” Bob said.
