Sean Fulton is an associate in Sullivan & Cromwell’s Litigation Group, and is a member of the Firm’s Products Liability and Mass Tort, Securities, and Criminal Defense and Investigations Practice Groups.  His practice focuses on representing multinational corporations and their officers in complex civil litigation, international arbitration, corporate internal investigations, and criminal defense matters before various agencies.

Sean also devotes time to the Firm’s pro bono matters, representing victims of domestic violence in proceedings for protective orders, a class of tenants in a suit for damages against their landlord, and criminal defendants in direct appeals, among others.

SELECTED REPRESENTATIONS

  • Stellantis N.V. (formerly Fiat Chrysler Automobiles N.V.) in numerous federal and state actions, including multidistrict litigation in San Francisco, as well as a regulatory investigation, regarding allegations that certain of their diesel vehicles emitted nitrogen oxides in excess of the limits imposed by U.S. law.  Work has included advising them on implementation of and compliance with the large-scale, nationwide settlement of class member claims related to the U.S. emissions issues and, more generally, representing them during all stages of the related class action litigation, opt-out litigation, securities litigation, and litigation with the companies’ primary regulators, including the U.S. Environmental Protection Agency and the U.S. Department of Justice.
  • Fiat Chrysler Automobiles N.V. and FCA US LLC in resolving an U.S. Securities and Exchange Commission investigation regarding its historical sales reporting practices.
  • Adient plc in securing dismissal of a securities fraud class action brought by shareholders alleging that the company publicly misrepresented the state of a meaningful segment of its business.
  • An African e-commerce company in connection with an internal investigation and advising on its compliance program and internal controls.
  • FCA US LLC in securing dismissal of most claims at the pleading stage of a putative nationwide consumer class action in the Eastern District of Michigan concerning an alleged defect in the Exhaust Gas Recirculation coolers in model year 2014–2019 Ram 1500 diesel trucks.
