Jacob Cohen is a member of the Firm’s Litigation Group. Mr. Cohen represents leading global companies and financial institutions in a wide variety of complex commercial litigations, including securities, federal RICO, banking, fraud, merger-related disputes, and labor and employment actions.



SELECTED REPRESENTATIONS

  • Goldman Sachs in a class action alleging securities fraud in connection with mortgage-related activities and alleged conflicts of interest, including securing a favorable U.S. Supreme Court decision.
  • Goldman Sachs in obtaining summary judgment dismissing class action fraud claims brought by investors alleging losses exceeding $2 billion in two CDO transactions.
  • Goldman Sachs in obtaining dismissal of claims for fraud, negligent misrepresentation, and unjust enrichment brought by a German bank concerning a CDO transaction.
  • Fiat Chrysler in obtaining dismissal of RICO claims brought by General Motors purportedly related to improper payments to the union of United Auto Workers, as well as in a related state court action alleging the same claims.
  • Fiat Chrysler in obtaining dismissal of two proposed class actions and an individual action brought by auto workers alleging that the company colluded against them with the union of United Auto Workers.
  • Eisai in a breach of contract action against Pfizer and Viatris relating to sales of the generic form of Lyrica® in Japan.
  • Banco Santander (Brasil) in a litigation against American Airlines seeking a declaratory judgment that their co-brand credit card agreement has been terminated as a result of American Airline’s cessation of flights to Brazil as a result of the COVID-19 crisis.
