S&C Litigation partner Jeff Scott has authored an
article for The Review of Securities & Commodities Regulation in which he examines recent trends and priorities for the Enforcement Division of the Securities and Exchange Commission. Trends observed include a continued emphasis on cooperation, an increase in the pace of investigations, and the imposition of non-monetary relief that furthers the SEC’s priorities—such as independent consultants and undertakings. The article also examines the continued prevalence of whistleblowers in SEC investigations, and offers guidance to practitioners handling such investigations in light of the trends and priorities observed.
