This S&C Tariffs Tracker update discusses several recent developments in U.S. trade policy and customs enforcement.
- First, the Trump administration, pursuant to Section 301 of the Trade Act of 1974 (“Section 301”), imposed a 10% to 12.5% tariff rate on 60 economies for failing to prohibit importation of goods produced wholly or in part with forced labor.
- Second, the Trump administration announced a 50% tariff on many products from Canada, including dairy, alcoholic beverages and motor vehicles, pursuant to Section 338 of the Tariff Act of 1930.
- Third, the Trump administration announced 25% tariffs on certain goods of Brazil pursuant to Section 301.
- Fourth, United States Trade Representative Jamieson Greer announced that the ongoing structural excess capacity investigation, conducted pursuant to Section 301, would not be completed before the 10% Section 122 tariff expired on July 24, 2026.
- Fifth, the Government filed notices of interlocutory appeal challenging four orders of the Court of International Trade requiring broad refunds of tariffs imposed under the International Emergency Economic Powers Act.
- Finally, the DOJ continues to prioritize tariffs and trade enforcement and published a resource guide to trade enforcement.
