    CFTC Staff Withdraws Digital Asset Advisories

    Withdrawals Meant to Ensure that Treatment of Digital Asset Listing and Clearing Matters Will Be Consistent with Treatment of Other Products

    On March 28, 2025, CFTC Staff issued two letters announcing the withdrawal of two digital-asset related advisories that imposed certain requirements on (i) the listing of digital asset derivatives on a designated contract market or swap execution facility, and (ii) the clearing of transactions in such contracts through a derivatives clearing organization. These letters reflect the CFTC’s revised approach to the regulation and supervision of digital asset markets and market participants in response to President Trump’s January 23, 2025 Executive Order on “Strengthening American Leadership in Digital Financial Technology.”
