The UK Competition and Markets Authority (“CMA”)’s Microsoft/Inflection decision (published yesterday) is the first published decision by a competition authority assessing a so-called “acquihire” transaction. It gives valuable insight into how the CMA will analyse similarly structured transactions in the future.
