The Federal Trade Commission published a policy statement that describes seven potentially deceptive or unfair acts or practices under Section 5 of the FTC Act relating to the collection, use and disclosure of biometric information. The publication of the policy statement signaled the FTC’s intent to carefully scrutinize this issue, and the FTC has subsequently brought several enforcement actions against companies for processing voice and video recordings and genetic information, all of which are defined as “biometric information” in the policy statement.
