S&C Partners Julia Jordan, Tracy Richelle High, Diane McGimsey and Ann-Elizabeth Ostrager authored the “USA Trends and Developments” chapter of the Chambers HR Internal Investigations Guide 2025. They offer perspective into evolving legal trends employers will continue to navigate in 2025, how these trends could impact workplace investigations, and issues that might arise in the course of investigations. The authors note that there will likely be a shift toward more employer-friendly policies at the federal level under the current administration.
The authors also discuss an increase in retaliations claims in recent years, which can be attributed to a number of factors including the expanded protections provided to employees; as well as complainant and witness confidentiality considerations in connection with investigations. Technology, and the increasing use of AI in internal investigations and monitoring processes, is another key area employers must address in their policies, according to the authors.
