On March 4, 2025, Attorney General Pam Bondi moved to intervene in a lawsuit that challenges an Illinois law requiring nonprofits to disclose their officers’ and directors’ demographic information. On March 11, 2025, the district court granted the Justice Department’s motion.

Illinois SB 2930 requires certain nonprofits in Illinois to publicly disclose their officers’ and directors’ demographic information, including their race, ethnicity, gender, sexual orientation, and gender identity. The United States Government is intervening in a lawsuit that challenges SB 2930, American Alliance for Equal Rights v. Bennett, No. 25-cv-669 (N.D. Ill. 2025). Both the plaintiff and the United States, as plaintiff-intervenor, argue that the law violates the Equal Protection Clause of the Fourteenth Amendment. According to the United States, SB 2930 “pressures nonprofits to consider candidates’ race when selecting officers and directors.” Doing so, it argues, constitutes impermissible, race-based discrimination. As of the date of this blog post, Illinois has not yet replied to the complaint.
Employers should continue to closely monitor the changing political and legal landscape in this area.
