In his latest column for Reuters’ Practical Law, Senior M&A Partner Frank Aquila offers an overview of recent developments in shareholder activism and suggests strategies for boards to consider in navigating through continued uncertainty in the second half of the year.

Frank reviews the continually evolving political, economic and regulatory environment, as well as the widening divergence in shareholder, employee and stakeholder expectations. He discusses proactive strategies that companies can adopt to prepare for activist campaigns with these developments in mind, including legal defenses, board refreshment and monitoring the shareholder base.

“Similar to pandemic-era activism, it is likely that once the initial period of uncertainty passes, activists will target companies that underperformed industry peers during that period,” he writes.
