Co-Head of S&C’s Employment Law Group Annie Ostrager and Practice Area Associate William Wolfe co-authored an article for Bloomberg Law on the evolving non-compete landscape at the national and state levels in the U.S. The authors discuss challenges in enforcing non-compete agreements in light of these developments, and offer options such as non-solicitation and confidentiality agreements, as well as garden leave, as viable alternatives to safeguard business interests.
“[E]mployers may want to evaluate their use of non-compete agreements and consider additional ways to protect confidential information and trade secrets, client goodwill, and investments in key employees,” the authors write.
