S&C litigation partner Ann-Elizabeth Ostrager, together with associates Jacob Singer and Madeleine Bruml, co-authored an article in
Law360 on an employment case that could have ramifications for bias cases brought under Title VII of the Civil Rights Act.
Now pending before the Supreme Court in
Peterson v. Linear Controls is a petition for certiorari, which presents the question of what constitutes an adverse employment action under Title VII. Should the Court grant the petition, the article says, its decision in the case “could redefine the scope of Title VII’s protections for discrimination in employment and have implications beyond Title VII.” The Court’s decision could also signal its views on Title VII and discrimination law more generally, the authors write.
