The German Government has approved a draft law to further tighten foreign investment control in line with new EU requirements. The new law lowers the standard of review and extends the scope of assessment. The proposal also introduces gun-jumping prohibitions – a novelty in German investment control. The new regime will increase transaction risk and require additional care from both buyers and sellers.
