The FDIC has adopted an amendment, proposed in July 2019, to its Securitization Safe Harbor Rule eliminating the safe harbor’s requirement that information provided to potential investors comply the requirements of the SEC’s Regulation AB whether or not the securities to be issued are publicly offered.
