On December 7, Mr. Williamson appeared on The Federalist Society podcast SCOTUScast, to discuss the Supreme Court’s November 30 decision in OBB Personenverker v. Sachs, in which a unanimous Court clarified the scope of the commercial activity exception in §1605(a)(2) of the Foreign Sovereign Immunities Act, which withdraws sovereign immunity in any case “in which the action is based upon a commercial activity carried on in the United States by [a] foreign state.”
