S&C partners Rita-Anne O’Neill and Jim Bromley participated in a panel at the American Bar Association’s Business Law Virtual Section Annual Meeting, held from September 21-25. Rita, co-head of S&C’s Global Private Equity Group, moderated the panel, “Buying Assets in a 363 Sale for the M&A Generalist,” which included Jim, co-head of S&C’s Global Restructuring practice, as a featured speaker. The panel provided M&A attorneys with an overview of the sale process under Section 363 of the Bankruptcy Code and offered tips and strategies for negotiating a 363 asset purchase, a topic that is becoming more important as continued bankruptcies are expected as a result of the COVID-19 pandemic.
