Ann-Elizabeth Ostrager examined the SEC’s approach to the extraterritorial reach of its jurisdiction in an article for
New York Law Journal titled, “Will the SEC Take an Expansive Approach to the Extraterritorial Reach of Its Jurisdiction?” In the article, Annie notes that the recent decision by the U.S. Court of Appeals for the Tenth Circuit in
SEC v.
Scoville held that the Dodd-Frank Act gives the SEC greater ability to enforce federal securities laws in the context of conduct that takes place outside of the United States than had previously been the case. “Although it remains to be seen whether other circuit courts will align with the Tenth Circuit’s decision in
Scoville, this decision may alter and expand the playing field when navigating an SEC investigation or litigation,” Annie writes.
