Andy Dietderich continues his examination of forum shopping in the October issue of the ABI Journal, following an article he authored on the topic in September. In part two of “Confessions of a Forum-Shopper,” Andy focuses on cross-border restructurings and the means by which foreign debtors can make use of U.S. chapter 11 proceedings. Andy argues that the ability for foreign debtors to “forum shop” into a chapter 11 proceeding in the United States “will always be necessary for a subset of international debtors,” and that non-U.S. courts, companies and creditors need not be concerned when such a chapter 11 proceeding occurs.
