Gauthier Blanluet Authors Article in Les Echos

December 17, 2012

In its December 12 issue, the leading French financial newspaper Les Echos published an article by Mr. Blanluet, “L’absurdité de la fraude fiscale sans soustraction à l’impôt.” The article points out flaws in the French judicial system that currently allow someone charged for tax fraud simultaneously in both the administrative and criminal courts to be prosecuted in the criminal courts and receive a prison sentence, even if the person was initially acquitted of tax fraud and related penalties in the administrative court. The issue stems from the fact that the two courts are independent of each other. Although attempts to revise legislation to avoid this weakness in the French judicial system have been proposed, the problem persists.
