Mr. Aquila and Ms. Sawyer wrote the article, “Speed Reading: Top 10 Issues to Consider When Designating Directors,” in the July 2011 issue of LexisNexis’ Emerging Issues. The article identified 10 critical issues investors who acquire a significant stake in a company should bear in mind when designating directors for the target company’s board. Mr. Aquila and Ms. Sawyer noted that director designees can have an influential role in the board room, but that their use also raises a host of complex legal and other questions.
