• Represents Volkswagen in an enforcement action brought by the U.S. Securities and Exchange Commission relating to bonds sold to institutional investors.
• Represents Volkswagen in a putative securities fraud class action brought by private bondholders, successfully convincing the Ninth Circuit to grant interlocutory appeal and reverse the District Court’s summary judgment decision relating to a presumption of reliance.
• Represented Volkswagen in a putative securities fraud class action brought by purchasers of VW ADRs based on Volkswagen’s voluntary disclosure about potential anti-competitive conduct under European law, obtaining dismissal and winning on appeal.

• Represented Porsche SE in securities fraud actions in connection with its acquisition of a stake in Volkswagen, obtaining dismissal of federal claims and winning federal and state appeals.
• Represented UBS and former officers and directors in securities putative class action relating to mortgage-related and auction rate securities as well as cross-border tax issues, obtaining dismissal of claims and successfully defending appeal.

Selected Products Liability Cases

• Represents Volkswagen in a products liability case, successfully opposing class certification and then obtaining summary judgment, in a putative consumer class action alleging fraud in connection with Volkswagen’s certified pre-owned vehicle program.
• Represented Volkswagen Group of America and Audi of America in a products liability lawsuit involving the recall of vehicles equipped with Takata airbags, the largest automobile recall in U.S. history, obtaining dismissal of non-U.S. parents and settling remaining claims on favorable terms.

Selected Antitrust Cases

• Represents Goldman Sachs in a putative antitrust class action relating to warehousing of aluminum, as well as related regulatory and government investigations.
• Represented Volkswagen and Audi in an antitrust lawsuit, based on allegations by a German media outlet that five German automakers had been secretly exchanging technical information since the 1990s, obtaining dismissal and successfully defending the appeal.
• Represented Volkswagen in an antitrust action brought by an automotive supplier network, obtaining dismissal and winning on appeal.

Selected Other Cases

• Represents BNP Paribas in a putative class action brought by Sudanese refugees alleging tort claims under Swiss law.
• Represents Porsche SE in various Section 1782 actions involving underlying litigation in Germany.
• Represented Goldman Sachs in employment putative class action alleging gender discrimination with respect to compensation, promotion and performance evaluations.
• Represented JPMorgan Chase in various federal and state actions relating to residential mortgage-backed securities.
• Represented UBS in ERISA “stock drop” class action, obtaining dismissal and successfully defending the appeal.
• Represented Goldman Sachs in connection with an industry-wide investigation relating to the practices of mutual funds and their customers.
• Represented JPMorgan Chase in a lawsuit relating to its merger with Bank One.
