    Stephen Clarke is a member of the Firm’s Litigation Group. His practice focuses on complex commercial litigation and bankruptcy litigation. Mr. Clarke has represented financial institutions in connection with class actions and individual actions involving antitrust, RICO, CEA, and state law claims related to the alleged manipulation of numerous benchmark interest rates and financial markets. Mr. Clarke has also represented financial institutions in high-stakes criminal and regulatory investigations related to “spoofing” and benchmark manipulation.  Further, Mr. Clarke has experience litigating contested matters, adversary proceedings, and appeals arising from bankruptcy proceedings.

    • Barclays, in litigating and resolving favorably numerous class actions and individual actions related to alleged manipulation of benchmark interest rates, including USD LIBOR, Sterling LIBOR, Euribor, ISDAFIX, the Singapore Interbank Offered Rate (“SIBOR”) and the Singapore Swap Offer Rate (“SOR”).
    • National Australia Bank, in obtaining dismissal and a favorable settlement of a putative class action alleging antitrust, CEA and RICO violations related to the Australian Bank Bill Swap Reference Rate (“BBSW”).
    • Royal Bank of Canada, in obtaining dismissal with prejudice of a putative class action alleging antitrust violations related to sovereign, supranational and agency bonds, and in obtaining affirmance on appeal.  
    • Barclays, in obtaining a favorable settlement of a putative class action alleging antitrust violations related to Mexican government bonds.

    • JPMorgan Chase, in obtaining dismissal of many claims in a consolidated securities fraud litigation arising out of the bank’s 2012 so-called “London Whale” trading losses, and in a settlement resolving remaining claims.
    • Barclays, in two actions related to alleged manipulation of the VIX Index amid “Volmageddon” in February 2018.
    • Barclays, in three putative securities fraud class actions arising out of Barclays’ sale of unregistered securities and related cessation of ETN issuances in March 2022.
    • Scotiabank, in obtaining coordinated resolutions with the DOJ and CFTC resolving investigations of spoofing involving precious metals futures contracts.
    • Barclays, in obtaining coordinated resolutions with the DOJ, CFTC, the U.K. FSA of matters relating to the alleged manipulation of benchmark interest rates, including LIBOR and Euribor.
    • FTX Trading Ltd., and various of its affiliated debtors in contested matters and appeals related to their global Chapter 11 bankruptcy proceedings.
    • LSC Communications Inc., in various matters and an appeal related to its Chapter 11 proceedings.
    • FCA US LLC (formerly Chrysler Group LLC), in post-closing litigation relating to enforcement of the sale order approving the historic bankruptcy acquisition of Chrysler's assets.
    • Eastman Kodak Company, in its Chapter 11 proceeding, including related adversary proceedings and contested matters.
    • Barclays, in successfully resolving employment-related whistleblower, breach of contract and indemnification claims brought by three former derivatives traders seeking payment of legal fees in connection with their U.K. criminal trial regarding alleged USD LIBOR-related conduct.
