    Michael Lemanski is an associate and a trial lawyer in Sullivan & Cromwell’s Litigation Group.  His practice spans a broad range of high-stakes civil litigation and arbitration matters, with an emphasis on intellectual property, M&A, corporate law, and complex commercial disputes.  Michael has significant trial experience, including presenting and cross-examining fact and expert witnesses.  Michael also regularly represents clients in make-or-break appeals before various state and federal appellate courts and advises corporate clients on disputes issues in connection with M&A and other transactional matters.

    As part of his pro bono practice, Michael helped to draft an amicus curiae brief in the U.S. Supreme Court in an economic freedoms case.

    • Trial counsel for a Global 500 life-sciences company securing a complete defense victory in a nine-figure patent-licensing dispute with a major competitor heard before a panel of AAA arbitrators.
    • Trial counsel for Masimo Corp. securing a $634 million patent-infringement jury verdict against Apple Inc. After an eight-day trial, federal jurors in Orange County, California found that Apple infringed Masimo’s patent for a low-power pulse oximeter and awarded the damages Masimo requested.
    • Trial counsel for Bayer AG securing a complete defense victory on multi-billion-euro claims in an ICC arbitration brought by BASF SE relating to assets BASF acquired from Bayer in connection with Bayer’s $66 billion acquisition of Monsanto Company.
    • Trial counsel for Ocado Group plc in its complete defense victory on patent-infringement claims brought by competitor AutoStore AS after a bench trial in the U.S. International Trade Commission (ITC). Michael also represented Ocado in an appeal before the Federal Circuit defending the ITC decision and in patent-infringement and antitrust cases brought by Ocado against AutoStore. AutoStore ultimately settled the litigations it initiated, agreeing to pay Ocado more than £200 million.
