    Elizabeth Rose is a special counsel in the Firm’s Litigation Group. Her practice focuses on complex civil litigation at the trial and appellate level and has included arguing appeals in the U.S. Court of Appeals for the Third Circuit, Fifth Circuit, and Ninth Circuit. Ms. Rose has clients in both federal and state court and before arbitration tribunals in a variety of matters, including securities fraud, consumer fraud and product liability, antitrust, and merger-related disputes.

    Ms. Rose has also been actively involved in the Firm’s pro bono practice, including representing individuals on appeal in civil rights actions asserting claims under Section 1983.

    Experience

    • Represented BP p.l.c. in a consolidated securities fraud class action arising out of the Deepwater Horizon explosion and subsequent Gulf of Mexico oil spill.  Obtained denial of class certification for all but one month of the more than two-year proposed class period and succeeded in defending that decision on appeal in the Fifth Circuit.  
    • Represented BP p.l.c. in multiple appeals in the Fifth Circuit stemming from claims made under the Deepwater Horizon Economic and Property Damages Settlement. 
    • Represented car manufacturers, including Fiat Chrysler Automobiles and Volkswagen, in multidistrict litigation and putative class action litigation involving state law fraud and consumer protection act claims, among others, following various vehicle recalls.     
    • Represented British Airways p.l.c. in obtaining favorable decision in action stemming from settlement of class action antitrust litigation and succeeded in defending that decision on appeal in the Ninth Circuit.  
    • Represented First Horizon National in several pre- and post-merger lawsuits in connection with its acquisition of Capital Bank Financial. 
    • Represented an international oil company in obtaining dismissal of claims in an AAA arbitration arising from a dispute with a third party that accused the oil company of participating in bribery in connection with securing an exploration and drilling contract with a foreign sovereign.  
    • Represented an individual, pro bono, in a successful appeal before the Third Circuit following an unfavorable jury verdict on his civil rights claims involving police misconduct, resulting in a unanimous reversal and remand for a new trial and reinstatement of claims dismissed on summary judgment. 
    • Represented a state prisoner, pro bono, in successful appeal before the Ninth Circuit relating to his claims of deliberate indifference to his serious medical needs under Section 1983.
