    Amanda Flug Davidoff is the Managing Partner of S&C’s Washington, D.C. office and is Deputy Managing Partner of the Firm’s Litigation Group. She represents clients in a wide range of civil litigation matters at both the trial and appellate level, with a focus on complex securities and antitrust class actions and regulatory litigation. Amanda also represents clients in high-stakes antitrust regulatory matters and government investigations. She serves on the Board of Advisors of the Yale Law School Center for the Study of Corporate Law.

    • Represented BP in securing the dismissal, upheld on appeal to the Second Circuit, of a multi-district class action alleging antitrust and Commodity Exchange Act claims relating to alleged overseas manipulation of Brent Crude Oil that allegedly harmed derivatives traders in the United States.
    • Counsel to BP in defending against climate-change-related litigation throughout the United States, including against antitrust and civil RICO claims.
    • Represented BP in securing the dismissal of a purported class action alleging breach of fiduciary duty and aiding-and-abetting breach of fiduciary duty brought by former shareholders of TravelCenters of America Inc. in connection with BP’s May 2023 acquisition of TravelCenters.
    • Represented BP in obtaining dismissal in part, and partial denial of class certification, of securities fraud class action claims arising out of the Deepwater Horizon spill. Secured denial of class certification for all but one month of the more than two-year putative class period and successfully defended that victory on appeal to the Fifth Circuit.
    • National coordinating counsel to BP in litigation and investigations arising out of the February 2021 winter storm in Texas, including trying a contract dispute to a favorable result and litigating multiple pending class actions in Kansas federal court.

    • Counsel to the Republic of Argentina in its three most significant ongoing litigation matters: two lawsuits brought by hedge funds in the Southern District of New York and London relating to GDP-linked securities and a breach of contract action in the Southern District of New York related to Argentina’s 2012 expropriation of shares in a publicly-traded oil company.
    • Representing Argos USA LLC, the U.S. subsidiary of Colombia-based Cementos Argos S.A., in a District of South Carolina class action concerning alleged price-fixing and bid rigging in ready-mix operations in Georgia and South Carolina from 2010 to 2018.
    • Lead counsel to ING in obtaining a favorable early settlement of an antitrust class action alleging that multiple financial institutions conspired to manipulate the Singapore Interbank Offered Rate (SIBOR) and the Singapore Swap Offer Rate (SOR).
    • Lead counsel to Nomura in obtaining the dismissal of all claims against it in multi-district class actions alleging manipulation of auctions for U.S. treasuries and derivatives in violation of federal antitrust and commodity exchange laws.
    • Counsel to Microsoft in in its defense of more than a dozen consumer class actions alleging antitrust damages and business fraud claims, including a 16-week jury trial in Des Moines, Iowa which settled on terms favorable to Microsoft during the plaintiffs’ case-in-chief.
    • Counsel to British Airways in obtaining favorable settlements with the government and class plaintiffs in two global criminal antitrust investigations and in related multi-district class action lawsuits over allegations of price-fixing of fuel surcharges.
    • Represented mutual fund trustees in obtaining the dismissal, affirmed on appeal to the Second and Third Circuits and the Delaware Supreme Court, of derivative and class actions alleging RICO claims and breaches of fiduciary duty.
    • Lead counsel to JPMorgan Chase and its affiliates in all of its Commodity Exchange Act, securities and derivative litigation arising out of alleged spoofing of precious metals derivatives and U.S. treasuries and derivatives, including obtaining the dismissal, upheld on appeal to the Second Circuit, of a consolidated multi-district class action alleging manipulation of silver futures, and the dismissal of the securities fraud class action.
    • Lead counsel to Sallie Mae Bank in obtaining the dismissal of lawsuits by the Illinois Attorney General and Mississippi Attorney General alleging violations of the states’ Consumer Fraud Acts in connection with student loan origination.
    • Represented UBS Group AG in obtaining dismissal of a shareholder derivative action filed in New York Supreme Court alleging that UBS board members violated their fiduciary duties under Swiss law.
    • Lead counsel to the underwriters of a bond offering by Under Armour in obtaining the dismissal of securities class action against underwriters arising out of alleged misstatements concerning Under Armour’s business, operations and prospects.
    • Represented Nomura in a four-week bench trial, and on appeal, of a securities action brought by the Federal Housing Finance Agency concerning Freddie’s and Fannie’s purchase of RMBS before the financial crisis.
    • Represented Goldman Sachs in securing a favorable settlement of a class action employment discrimination lawsuit after obtaining rulings that narrowed class membership and the availability of damages.
    • Lead counsel to First Horizon in obtaining favorable settlements or dismissals in a broad range of securities and contract actions concerning RMBS and mortgage loans sold before the financial crisis.
    • Lead counsel to a U.S. financial institution in all investigations related to the COVID-era Paycheck Protection Program.
    • Lead counsel to Nomura in an unjust enrichment action seeking to recover repayments of secured loans made before a Brazilian debtor’s bankruptcy.
    • Represented Volkswagen, Audi, and Porsche in obtaining the dismissal, upheld on appeal to the Ninth Circuit, of two antitrust class actions filed by indirect and direct purchasers of German vehicles alleging that the automakers—along with BMW and Daimler—conspired to reduce innovation in German vehicles in violation of the Sherman Act and other antitrust and consumer protection laws.
    • Counsel to international clients in ongoing arbitrations.
    • Counsel to an array of clients on merger approval, with related advocacy before regulators.
