    Alexander Gross is a trial lawyer and a partner in Sullivan & Cromwell’s Litigation Group. His practice includes a broad range of litigation matters in a variety of venues, with an emphasis on intellectual property, technology, antitrust, and complex commercial disputes. Mr. Gross has significant trial experience for both plaintiffs and defendants, including cross-examining adverse witnesses, and has successfully argued numerous motions, including claim construction, motions to exclude expert testimony, discovery motions, and evidentiary motions. He also has represented clients in appeals to the Federal, Second, and Fifth Circuits. Mr. Gross has been recognized by The Best Lawyers: Ones to Watch in America for Commercial Litigation in 2024 and 2025, and was named as a runner-up “Litigator of the Week:” by The American Lawyer in January 2025.

    Mr. Gross’s pro bono practice includes achieving a successful resolution for a client in New York State housing court and representing clients in criminal matters in the Eastern District of New York.

    Intellectual Property Disputes

    • Columbia University as trial counsel in litigation against NortonLifeLock in which Columbia asserted patent infringement and correction of inventorship claims.  After a two-week jury trial in the Eastern District of Virginia, a jury of eight unanimously found in Columbia’s favor on all patent infringement claims and correction of inventorship.  The jury awarded Columbia $185 million and found that Norton’s infringement was willful, leading the Court to award enhanced damages and increasing the verdict to more than $600 million.

    • Columbia University in two related appeals to the Federal Circuit stemming from Columbia’s trial-court win against NortonLifeLock.

    • Ocado Group as trial counsel in successful defense of ITC Section 337 investigation based on allegations of infringement of five patents in which the judge ruled in Ocado’s favor on all claims and patents, finding three patents invalid and one not infringed (the fifth patent was withdrawn the day before trial).

    • Ocado Group in a patent infringement lawsuit filed against a competitor, AutoStore, in the District of New Hampshire. The case settled for $250 million in the run-up to a jury trial.

    • Lexeo Therapeutics in defending against alleged trade secret misappropriation claims and asserting counterclaims for trade secret misappropriation, breach of NDA, and correction of patent inventorship against a competitor in the SDNY.  The case settled on terms favorable to Lexeo with no admission of liability.

    • Security First Innovations in patent litigation against two large technology companies pending in the Eastern District of Virginia.

    • BlackBerry Limited as hearing counsel in successful pursuit of its $1 billion patent license claim against Qualcomm Incorporated in a JAMS arbitration seated in California.

    Complex Commercial Litigation, Antitrust Disputes, and Other Matters

    • Goldman Sachs in obtaining dismissal of various contract and tort claims relating to an abandoned transaction brought by KSFB Management in the Commercial Division of the New York Supreme Court.

    • Goldman Sachs in litigation pending in the Delaware Chancery Court in which plaintiffs allege that Goldman aided and abetted breaches of fiduciary duty in connection with the acquisition of Focus Financial Partners by Clayton, Dubilier & Rice.

    • Credit Agricole in obtaining dismissal of a class action complaint alleging violations of the Sherman Act relating to the setting of the USD ICE LIBOR benchmark interest rate, and affirmance of that dismissal by the Second Circuit.
    • Novartis in connection with its $9.7 billion acquisition of The Medicines Company.

    • Bayer AG in connection with successful global antitrust clearance of Bayer’s $66 billion acquisition of Monsanto Company, including post-clearance audits by a monitoring trustee.

    • A biotechnology company in the successful resolution of employment-related claims.
